- We are Bank of Nassau 1982 Limited (the “Bank”), a limited liability company incorporated as company no. 28107 pursuant to the laws of the Commonwealth of The Bahamas and we own and operate this website (the “Site”).
- Binding Terms: Your use of the Site is subject to these Terms of Use. By using the Site, you will be deemed to have accepted and agreed to be bound by these Terms of Use and you shall be bound to comply with all applicable laws and regulations. If you do not agree to these Terms of Use, please do not use this Site and immediately discontinue your access.
- Changes: We may make changes to these Terms of Use from time to time. We may notify you of such changes by any reasonable means, including by posting the revised version of these Terms of Use on the Site or the date LAST UPDATED. By using the Site following changes made to these Terms of Use you will be deemed to have accepted those changes.
- Internet Security: You are responsible for all access to the Site using your Internet connection, even if the access is by another person. The Site is an internet-based application and the internet is a public network over which the Bank has no control. Any access to the internet could bear some risks such viruses, risk of forgery or abuse. The Bank is not responsible to you or any third party for damage incurred as a result of such risks and/or as a result of technical deficiencies (transmission error, network overload, interference, maintenance, unauthorized third party access, etc.). Internet Security. The Bank is not responsible for any damage caused or losses to your equipment, the data stored therein or any software or hardware components used to operate your equipment. You commit to take all necessary security measures and assums all risks connected to non-authorized, incorrect or fraudulent use of the Site.You use the Site at your own risk and bear all responsibility for compliance with any applicable laws, rules, and regulations in your jurisdiction of residence or domicile.
- Restrictions: We reserve the right to restrict your access to the Site or part of it. Access to restricted areas of the Site may be subject to registration and other conditions. If we grant you permission to access a restricted area, we may withdraw that permission at any time (including where you breach any of these Terms of Use). We will use all reasonable efforts to ensure that the Site is available at all times. However, we cannot guarantee that the Site or any individual function or feature of the Site will always be available and/or error free. In particular, the Site may be unavailable during periods when we are implementing upgrades to or carrying out essential maintenance on the Site.

You may not print or otherwise make copies of, reproduce nor distribute any content from this Site without the Bank’s express prior written permission. The Site may provide links to other websites and online resources, the intellectual property of which the Bank does not own or control. We are not responsible for and do not endorse such external sites or resources. Your use of third party websites and resources accessed by a link on this Site is at your own risk.
- User Obligations: Your permission to use the Site is personal to you and is non-transferable, you may not use the Site for commercial purposes. Your use of the Site is conditional on your compliance with the requirements set out in these Terms of Use and by using the Site you agree that you WILL NOT:
- use the Site for any fraudulent or unlawful purpose;
- use the Site to defame, abuse, harass, stalk, threaten or otherwise violate the rights of others, including without limitation others’ privacy rights or rights of publicity;
- impersonate any person or entity, falsely state or otherwise misrepresent your affiliation with any person or entity in connection with the Site; or express or imply that we endorse any statement you make;
- interfere with or disrupt the operation of the Site or the servers or networks used to make the Site available; or violate any requirements, procedures, policies or regulations of such networks;

Notwithstanding the foregoing, we grant the operators of public online search engines limited permission to use search retrieval applications to reproduce materials from the Site for the sole purpose of and solely to the extent necessary for creating publicly available searchable indices of such materials solely in connection with each operator’s public online search service. We reserve the right to alter, modify or revoke these exceptions either generally or in specific instances.
- Data Protection: Data and information about you which may be collected by virtue of your use of the Site, is subject to the laws of The Bahamas regulating use of personal information and data. Such data which may be collected by the Bank shall only be used, processed and communicated in accordance with applicable laws of The Bahamas. Pursuant to the Data Protection (Privacy of Personal Information) Act, 2003 Ch324A and the Bank & Trust Companies Regulations Act, 2020 or as amended from time to time, the User in exchange for the use of this Site, hereby consents to the sharing and provision of your data and information to other members of the Bank or the transfer of such data to a third party, for purposes of assisting the Bank with carrying out banking services for your benefit in accordance with the Bank’s legal, operational, contractual obligations and its banking or securities’ custody obligations that may arise. The treatment and transfer of data shall not be regarded in any case as a violation of bank secrecy. Natural persons have a right of access and rectification as provided for by the laws of The Bahamas; any such requests for access and rectification shall be made in writing. The Bank shall take all reasonable steps to ensure the confidentiality of your data.
- Confidentiality: The Bank will treat all of your personal information as private and confidential even if the User is no longer a customer. However, the directors, officers and/or staff of the Bank may be required to by Bahamian law to provide evidence and information and the Bank will only disclose such information about you to third parties where compelled to do so by laws in effect and in force in The Bahamas, an order or directive of a regulatory authority in The Bahamas or of a Court of Commonwealth of The Bahamas, and in any circumstance where there is evidence of activities which constitute or would, had they occurred in The Bahamas, constitute a criminal offence in the Bahamas.
- Effective Date: These Terms of Use are effective until terminated. The Bank may, at any time and for any reason, terminate your access to or use of the Site. If we terminate your access to the Site you will not have the right to bring claims against us or our affiliates with respect to such termination. We and our affiliates shall not be liable for any termination of your access to the Site.
- Governing Law: The provisions of these Terms of Use shall be governed by, interpreted and construed in accordance with the laws of the Commonwealth of The Bahamas. By using this Site, Users submit to the jurisdiction of, and agree that, the courts of the Commonwealth of The Bahamas will have exclusive jurisdiction over any claim, dispute or matter arising in connection with these Terms of Use.
